Family Sponsorship

Sponsor requirements:

  • 18 years or older
  • Canadian citizen, permanent resident or registered Indian
  • Must sign an undertaking promising to provide for the basic requirements of the sponsored person
  • Sign an agreement with the sponsored person(s)
  • Must meet the Low-Income Cut-Off (LICO) – not required to sponsor a dependant child who has no dependant children, an adopted person under 18 years of age or a spouse or common-law partner with no dependant children or with dependant child who has no dependant children
  • In case of Parent/Grand Parent sponsorship program, must meet LICO + 30% for 3 pervious taxation years. Only proof from revenue Canada is accepted.

Sponsor restrictions:

  • Receiving social assistance for a reason other than disability
  • In dept of an immigration loan or child support payment obligations
  • Bankruptcy
  • Subject to a removal order
  • Convicted of a violent crime an offence of a sexual nature or results in bodily farm to a relative or an attempt or threat to commit it
  • Detained in any penitentiary, jail reformatory or prison
  • Did not include the relative to sponsor on own PR application
  • Previously sponsored a spouse, common-law partner or conjugal partner who became a PR less than 3 years ago
  • Was previously sponsored as a spouse, common-law partner or conjugal partner and became PR less than 5 years ago

Sponsored requirements:

Sister – brother- half sister – half brother

  • Under 18 years old
  • Orphan
  • Not married or in common law

Nephew – niece:

  • Under 18 years old
  • Orphan
  • Note married or in common law

Child to adopt in Canada:

  • Under 18 years old
  • Not married or in common law
  • Psychological condition report
  • Excessive medical demand does not cause inadmissibility
  • Cannot later sponsor biological relatives

Grandchildren:

  • Under 18 years old
  • Orphan
  • Not married or common law

Dependent children:

  • Under 22 years old unless mentally or physically dependant
  • Not married or in common law

Spouse:

  • Marriage must be legal and valid in Canada and country where marriage took place

Common Law partner:

  • Have been living together in a marriage like relationship for at least 12 ongoing months

Conjugal partner:

  • Has same level of commitment and permanence as marriage but situation beyond their control kept them from living together

Parent – Grandparent:

  • Must be in good health

Lonely family member sponsorship:

If the sponsor does not have any living relative mentioned in the above categories, who can be sponsored, and does not have any relatives who is a Canadian citizen or Permanent Resident, The Canadian citizen or PR can then sponsor any relative regardless or age or relationship
